These Terms of Use (“Terms”) govern your access to and use of the Cartune mobile application (“Cartune” or the “App”), developed and published by Vodeca (“we”, “our”, or “us”).
By downloading, installing, or using Cartune, you agree to be bound by these Terms. If you do not agree to these Terms, please do not download, install, or use the App.
Operating a vehicle requires your full, undivided attention. You acknowledge and agree that you will prioritize safe driving and focus on the road at all times. Do NOT interact with the Cartune application, customize layouts, or configure widgets while your vehicle is in motion. Any configuration adjustments must be performed only when the vehicle is safely and legally parked. Vodeca is not liable for any accidents, traffic violations, injuries, deaths, or property damage arising out of the use or misuse of Cartune while operating a vehicle.
Cartune does NOT collect, record, or store any of your private or personal data. None of your data is ever shared with or sold to third parties. The App operates completely offline on your device, ensuring total privacy.
1. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable, personal license to download, install, and run Cartune on iOS devices that you own or control, and to use the App in connection with compatible CarPlay units, strictly in accordance with these Terms and the usage rules set forth in the Apple App Store Terms of Service.
2. Restrictions on Use
You agree that you will not, and will not permit any third party to:
- Decompile, reverse engineer, disassemble, decrypt, or attempt to derive the source code of the App.
- Modify, adapt, improve, enhance, translate, or create derivative works from the App.
- Rent, lease, lend, sell, redistribute, or sublicense the App.
- Remove, alter, or obscure any proprietary notice (including copyright or trademark notice) of Vodeca or its affiliates.
- Use the App for any illegal, unauthorized, or dangerous purpose.
3. Intellectual Property
All intellectual property rights in and to Cartune, including but not limited to the codebase, designs, layouts, user interface assets, logos, and branding, are owned by Vodeca. Your license to use the App does not grant you any ownership rights or interest in our intellectual property.
4. Disclaimer of Warranties
Cartune is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, Vodeca, on its own behalf and on behalf of its affiliates and licensors, expressly disclaims all warranties, whether express, implied, statutory, or otherwise, with respect to the App, including all implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the App will meet your requirements, operate without interruption, meet any performance or reliability standards, or be error-free.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Vodeca or its founders, employees, or partners be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, loss of data, vehicle damage, personal injury, loss of privacy, or failure to meet any duty) arising out of or in any way related to the use of or inability to use the App, even if we have been advised of the possibility of such damages.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without giving effect to any choice of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms or the App shall be instituted exclusively in the courts of Istanbul, Turkey.
7. Updates to the App and Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make updates, we will revise the “Last updated” date at the top of this page. Your continued use of the App following the posting of changes constitutes your acceptance of the revised Terms. We may also release updates for the App, which you must install to ensure optimal compatibility and security.
